Social Security Disability and Appeals for Federal Court – Don’t Give up!
If you are denied at the Social Security Disability SSDI / SSI Administrative Hearing Level and receive an unfavorable decision from the ALJ, you can appeal this decision to the Appeals Council. If you are denied by the Appeals Council, you may appeal to Federal Court. I have helped claimants appeal from the Social Security Administration to Federal Court. The best result is when you are granted disability benefits referred to as a Sentence Four Reversal without a remand for a new hearing. Basically, the federal judge or magistrate recommends that you be found disabled and your benefits are granted and the decision below is reversed. I have appealed cases before the U.S. Federal Court of Virginia – Western District and U.S. Federal Court of West Virginia – Northern District. I have had success in the past and the court has granted our motion for summary judgment and the claimant wins benefits including back benefits. This is a happy day because the appeal process is ending and the payments will be issued in the near future. Don’t Give up!
